American Eagle filed a lawsuit against Amazon alleging the online marketplace is using AE’s trademark to sell knockoffs.
Here’s what you need to know about the case.
American Eagle VS Amazon
The retailer American Eagle is suing Amazon for using the trademark of AE’s Aerie line to promote third-party knockoffs, or dupes, of the brand’s products.
American Eagle launched its Aerie line in 2006, and Amazon does not sell official brand products…
IN FACT, THE BRAND “INTENTIONALLY DECLINED SO AERIE CAN FOSTER ITS OWN BRAND IDENTITY AND CUSTOMER EXPERIENCE.”
The lawsuit specifically alleges that Amazon is the Aerie trademark and its variations…
To trick customers into thinking they are getting original brand products.
Advertisers use these trademarks in ads to lure American Eagle customers to Amazon, where the platform offers dupes and counterfeits. AE also states that it contacted Amazon one month before filing the lawsuit…
But the company relabeled the products with variants of Aerie, including “Aries” and “Aeries.”
THE LAWSUIT IS SEEKING DAMAGES AND AN INJUNCTION.
Unfortunately for Amazon, this is not the first time they’ve been caught for trademark infringement. As more counterfeits and dupes flood the market…
The company started a team dedicated to pursuing criminal action against third-party counterfeits.
But it seems like Amazon still has more work to do, especially regarding American Eagle’s products.
